Protection of Personal Data  is the  most important thing for PT Qonex Indonesia Solusi (“We” or “Qonex.id”). We are committed to protecting and respecting the  privacy of users (“you” or “Users”) when accessing and using applications, websites (www.qonex.id and other websites we manage), features, technologies , the contents and products we provide (hereinafter,  collectively referred to as the “Application”).

 This Privacy Policy sets the foundation for how we collect, store, use, process, control, transfer, disclose and protect your Personal Data (as defined below). This Privacy Policy applies to all users of  the Application, unless set out in  a separate Privacy Policy. Please read our Privacy  Policy  carefully  so that you can understand our  approach and how we use the information.

If you are under the age of 18 (eighteen), please always notify and discuss this Privacy Policy with your parent or guardian where applicable.

By visiting, using the services, or registering an Account on Our Application, you, your parents, and/or guardians or trustees (as relevant) accept and agree to the approach and the methods outlined in this Privacy Policy.

Personal Data We May Collect

We collect information that identifies or may be used to identify, contact, or locate individuals or devices associated with that information (“Personal Data”). Personal Data including but not limited to the name, address, date of birth, phone number, email address, phone number of users and non-Users of our Application contained in the Application or contact on your mobile device, bank account and credit card details, gender, identification (including ID card, driver’s license, Tax ID, passport or family card) or mark other identifiers issued officially by the government. In addition, for other information, such as personal profiles, and/or unique identifying numbers, associated with or combined with Personal Data, such information It is also considered Personal Data. The Personal Data we collect may be provided by you directly or by third parties (e.g., when you register or use the Application, when you contact our customer service, or vice versa when you provide Personal Data to Us). We may collect information in a variety of forms and purposes (including purposes permitted  under applicable laws and  regulations).

We may collect Personal Data in the form of:

You may provide information through electronic forms on our Application or by correspondence by phone, electronic mail, and so on.  This information  includes information you provide including but not limited to when registering for our Application, subscribing to our services, searching for products, participating in online discussions, webinars or other social media functions on our Application, participating in competitions, promotions, or surveys, interacting with us through external services or applications such as forms, Instagram, Youtube and etc. , when you report an issue through our Application, as well as when you interact with us offline. We may ask you to verify the information you provide, to ensure the accuracy of the information.

If you register with our Application by using and/or connecting your social media accounts such as Facebook or Google, we may access the Personal Data you have provided to you. Such social media providers are in accordance with the policies of social media providers and we will subsequently manage and use such Personal Data in accordance with this Privacy Policy.

Personal Data that we collect.  For each of your visits to our Application, we may collect the following information automatically:

Technical information, including but not limited to the Internet Protocol (IP address) address used to connect your computer or device to the internet, your login information, type and version of the browser used, time zone settings, type and version of browser extensions (browser plug-in), operating system and Application;

Information about your visit, including but not limited to a complete list  of  Uniform Resource Locators (URLs) visited to, through and from our Application (including dates and time); transaction data  such as purchase and payment details;  products you see and/or are looking for;  interactions on the application include but are not limited to page response times,  download issues, length of visits on  a particular page, interaction information on the page (such as scrolling, clicking, or mouse movements),  the methods used to leave the site, as well as the phone number used to contact our customer service;

Information we receive from other sources. We may receive information if you use other sites that we operate or other services we provide. We also cooperate with third parties (including but not limited to for example, referral programs, business partners, sub-contractors in technical services, payment services and delivery, advertising networks, analytics providers, information search providers, and credit reference agencies) (“Our Partners”) and may receive information from them. We will take steps   within the limits of fairness to verify the information we obtain from other sources in accordance with the Applicable Regulations.

Use of Personal Data

We may use and/or process Personal Data that we have received for the following purposes:

Personal Data belonging to users of the Application. We will use and/or process this information:

to identify and register you as a user of the Application, as well as to administrate, verify, delete or manage your account on the Application;

to assist the Service Provider in providing certain services on the Application you wish to use;

to verify the linking (link generation) of your Qonex Account, in the event that you perform an account link between your Qonex account and other applications or platforms;

to process and facilitate payments you make for product purchase transactions or service subscriptions within the  Application through the available payment channels in the Application;

to carry out our obligations of providing information, products and services to you, including but not limited to information regarding updates to the Application or services on the Application;

to provide information relating to other products and services we offer to provide you with, or allow third parties to provide you with, information about products and services that we deem possible may interest you. If you are an existing User, we may contact you by phone, text message, email or other means with information about our products and services;

to notify you of changes to our products, services or services;

to ensure that the contents of our Application is presented in a manner that is most effective to you;

to manage and process any form of points, rewards, loyalty points, or other similar things you receive while using the App;

to monitor and analyze user activity, behavior and demographic data including service provider habits and responsiveness for the various services available on the Application;

to maintain, develop, test, improve and personalize the Application to meet your needs and preferences as a User.

Personal Data belonging to the Service Provider. We will use this information:

to identify and register you as a Service Provider on the Application, as well as to administrate, verify, delete or manage your  account on the Application;

to enable the provision of services by service providers to application users;

to process payments to the Service Provider for the provision of services to users of the Application by the Service Provider;

to manage and process bonuses that the  Service Provider may receive when providing services on the Application;

to process and respond to application users’ suggestions of services that the Service Provider has provided;

to perform our obligations in providing information, products and services to service providers  (including but not limited to information regarding updates to the Application or services on the Application);

to monitor and analyze user activity, behavior and demographic data including the habits and responsiveness of service providers for the various services available on the Application;

to provide reports in connection with the services that the Service Provider provides through the Application;

to maintain, develop, test, improve and personalize the Application to meet your needs and preferences as a service provider;

to monitor and analyze user activity, behavior and demographic data including the Service Provider’s habits and responsiveness for the various services available on the Application.

Information that we collect. We will use this information:

to manage and develop our services, applications and internal operations, including troubleshooting, data analysis, testing, research, and statistical and survey purposes others;

to improve our Application so that the contents are ensured to be presented in the most effective way to the User;

to enable Users to  participate in the features of our  interactive services, when the User wishes;

as part of efforts to ensure the safety and security of our Application;

to measure and understand the effectiveness of our advertising to Users and others, and to serve advertisements of products and services relevant to Users of the Application;

to provide feedback and recommendations to Users and other users in our Application regarding products and services that may interest you and them.

Information we receive from other sources. We may compile the information we receive from other sources with the information you provide and the information we collect. We may use this information or the aggregated information  for  the purposes set out above (depending on the  type of information we receive).

Information about third parties that you provide to us. You may provide us with Personal Data relating to other third-party individuals (including Personal Data relating to parents, family members, friends, or other individuals both Users and non-Users of Qonex Applications). You will of course need their consent first to do so – please pay attention to the “Acknowledgement and Consent” section, below, for further information.

If you use social features in our App, you may share other Users of our Application’s phone numbers stored in the contact list app or address book on your device so that we can help to make it easier for you to connect you with your friends and/or acquaintances who use these social features. The data contained in your contact list or address book is only used for 1 (one) contact synchronization process only, and we do not store it on the server and/or our database.

Any purpose other than those mentioned above, which we will notify you further upon  obtaining your consent at a later time.

Disclosure of Personal Data

We may disclose any relevant Personal Data such as name and class level through our Application and/or social media accounts for the purposes of announcements, competition results and/or Other activities organized by us.

We may also share or disclose your Personal Data with members of our  business group, which includes branches and subsidiaries, as well as its main parent company and subsidiaries  (“Affiliates”), in order, including but not limited to (i) the implementation of support of the provision of the Application by the Affiliate, (ii) the implementation of our  business activities by the Affiliate, and (iii)  data processing by affiliates.  The use and processing of Personal Data  received  by Affiliates from us is carried out in accordance with this Privacy Policy and the provisions of applicable laws and regulations.

We may share your Personal Data with third parties for the following purposes and to the extent   permitted by  applicable laws and regulations, including:

Business partners, agents, vendors, and sub-contractors in the implementation of contracts that we carry out with them or you in connection with the provision of the Application or other uses related to the use of Application by you;

Advertisers and ad networks that need data to select and offer ads that are relevant to you and other users. We do not disclose information about identifiable individuals, but we may provide them with aggregate information about our users (e.g. information that 500 men are under 30 have accessed their advertising links on a given day). We may also  provide aggregate information to assist advertisers  in reaching specific target audiences  (e.g., women in Central Jakarta). We may use the Personal Data we collect to meet advertisers’ requests by displaying their ads to that target audience;

Analytics providers and search engines that help us to improve and optimize our applications;

The Government, in the event that we are ordered, directed, requested, or permitted by an authorized government agency, for the purposes set out by the government policy and/or provisions of applicable laws and regulations;

Law enforcement agencies (including but not limited to the police, prosecutors, and judicial institutions), in the event that it is necessary for legal proceedings between us and you, or you with other third parties, whether in connection with your use of the Application or not.

We may disclose your Personal Data to third parties in the event of a corporate action occurring on our company:

In situations where we sell or buy companies and/or assets, we may  disclose data to potential buyers or sellers of such companies or assets;

If we or our parent company or the substantial assets associated therein are obtained by a third party, then the Personal Data held about our customers shall be one of the transferable assets;

If we are under the responsibility to disclose or share data in order to comply with legal obligations and other agreements; or protect the rights, property, and security of us, our customers, and others. This includes exchanging information with other companies and organizations for the purpose of protection from fraud and credit risk reduction.

In the event of sharing your Personal Data with third parties, we strive to ensure that third parties and our Affiliates maintain your Personal Data in accordance with applicable laws and regulations. Apply to remain secure from unauthorized access, collection, use, disclosure, processing or similar risks and store your Personal Data only for the duration of the Personal Data is needed to achieve the goals mentioned in this section.

Personal Data Storage

All personal information you provide to us is stored on a secure network.  All payment transactions on the Application will be encrypted. By submitting your Personal Data to the Application, you consent to the transfer, storage and processing that occurs on our Application. We will take steps within the reasonable limits necessary to ensure that such Personal Data is treated safely and in accordance with the Privacy Policy and the applied relevant regulations.

To the extent permitted by the relevant laws and regulations, all Personal Data you provide will be retained by us: (i) as long as you are still a user of our Application and (ii) when commencement of the retention period from the date on which you stop using our Application and/or from the request for deletion of your account and Personal Data; or (iii) in accordance with the original purpose of the collection of such Personal Data.

To the extent permitted by the relevant laws and regulations, your Personal Data may be stored or processed outside of Indonesia for one or more of the purposes stated in this Privacy Policy. We will always strive to maintain the security of your Personal Data and will only transfer your Personal Data outside Indonesia in accordance with the provisions of applicable legislation.

Security of Your Personal Data

Confidentiality of Personal Data is a priority for us and our affiliates. We will always take appropriate legal, appropriate organizational and technical action to ensure that your Personal Data is safe and secure. Any processing of your Personal Data will only be carried out in accordance with this Privacy Policy and applicable laws and regulations.

Please note that the transmission of information over the internet is not completely secure.    Nevertheless, we will do our best to protect such Personal Data. We cannot guarantee the security of data transmitted to our Application; the risk of any transmission is your responsibility.  Once we receive your Personal Data, we will use strict procedures and security features to prevent unauthorized access.

You are responsible for (i) maintaining the confidentiality of your account, including passwords and payment details, against anyone and (ii) maintaining and ensuring the security of your device used to access and use the Application.

In situations where we provide a One Time Password (OTP) (or you choose) a password that allows you to access certain parts of our Platform Application, you are responsible to maintain the confidentiality of your password. We ask and encourage you not to share your password with anyone.

Your Rights

You may request the deletion of your Personal Data on the Application or withdraw your consent for any or all collections, use or disclosure of your Personal Data by providing to us reasonable notice in writing through the contact details listed in this Privacy Policy.  Depending on the circumstances and nature of the application you have requested, you must understand and acknowledge that after withdrawal of such consent or removal application, you may no longer be able to use the Application.  Withdrawal of your consent may result in the termination of your Account or your contractual relationship with us, with all rights and obligations that arise entirely to be fulfilled. Upon the receipt of the notification to withdraw consent for the collection, use or disclosure of your Personal Data, we will inform you of the possible consequences. So that you can decide whether you still want to withdraw your consent or not.

You may ask us to access and/or correct your Personal Data that is in our possession and control, by contacting us through the contact details provided below.

Our Application may, from time to time, contain links to and from sites belonging to partnered networks, advertisers, and other affiliates. If you follow a link to one of these sites, please note that these sites have their own Privacy Policies and that we are not responsible or have any obligation to these policies. Please check these policies  before you submit any information to these sites.

Cookies Policy

When you use the App, we may place a number of cookies in your browser. Cookies are small digital files containing letters and numbers that we store on your browser or device’s hard drive with your consent. Cookies contain information that is transferred to your device’s hardware disk.

Cookies may be used for the following purposes: (i) enable certain functions, (ii) provide analysis, (iii) store your preferences; and (iv) allow the delivery of advertisements and advertising based on behavior. Some of these cookies will only be used if you use certain features, or choose certain preferences, while some of these Cookies will always be used.

We use cookies for the following reasons:

Cookies are required for the operation of our Application. This includes, for example, Cookies that allow you to enter secured areas of our Application, use shopping carts, or use electronic billing services;

Cookies allow us to recognize and count the number of visitors and see how visitors move around our Application when they use it. This helps us improve how our Application works, for example, by ensuring users find what they are looking for easily;

Cookies are used to recognize you when you return to our Application. This allows us to personalize our content for you, greet you by name, and remember your preferences (for example, your choice of language or region);

Cookies record your visits in our Application, the pages you have visited, as well as the links you have followed. We will use this information to make our Application and the advertisements installed   therein more relevant to your interests. We may also share this information with third parties for such purposes.

Please note that third parties (including, for example, advertising networks and external service providers such as web traffic analysis services) may also use these Cookies, where this is beyond our control. These cookies are likely to make our Application and the advertisements displayed therein more relevant to your interests, as well as improve the performance of our Application.

You may delete Cookies by performing a clear data function on your mobile app or web browser that allows you to reject the settings of all or part of cookies. However, you may not be able to access all or parts of our Application.

Recognition and Consent

You understand and agree that this Privacy Policy is an agreement in electronic form. Your action of ticking the box stating “I agree to the Privacy Policy” or any other means, apply when creating your  Account constitute your active consent to enter into an agreement with us, so that the enforceability of the Privacy Policy is lawful and legally binding and continues to apply throughout your use of the  Application.

By agreeing to the Privacy Policy, you and/or your parents, guardians or trustees (in the event that you are under the age of 18 (eighteen) years of age) acknowledge that you have read and understand this Privacy Policy and agree to all its terms. In particular, you agree and consent to us collecting, using, sharing, disclosing, storing, transferring and/or processing your Personal Data. You comply with this Privacy Policy.

In the event that you provide Personal Data relating to another individual (e.g. Personal Data relating to your spouse, family member, friend, or other parties) to us, then you represent and warrant that you have obtained the consent of that individual to, and hereby consent on behalf of that individual to collect, use, disclose and process their Personal Data to us.

Marketing Materials

We and our Partners may send you and/or your parents, guardians or customers direct marketing, advertising, and promotional communications through push-notifications on our Application, messages through the Application, postal mails, phone calls, short message services, email and/or other messaging applications (“Marketing Materials”) if you have agreed to subscribe to our mailing list, and/or agree to receive marketing and promotional materials from us. You may choose not to receive such marketing communications at any time by contacting us through the contact details listed in this Privacy Policy. Please note that if you choose to opt out, we may still send you non-promotional messages, such as receipts or information about your Account.

Anonymous Data

We may create, use, license or disclose your Personal Data available on the Application, with caveats that; (i) that all things that can identify have been deleted,  so that the data either alone or combined with other available data, cannot be linked to or associated with or unable to identify an individual, and (ii) similar data has been combined so that the original data forms part of a larger data set.

The techniques mentioned above also applies if you make; (i) a request for deletion of your account and Personal Data, (ii) withdraw permission to use our services and Applications, or (iii)  when you stop using our Application. We will delete any of your Personal Data after 5 (five) years from the time you make one of the three possibilities, if the Personal Data is no longer required to the services or purposes mentioned in this Privacy Policy, and where we no longer have a legal or business obligation to store your Personal Data.

Changes in Privacy Policy

Any changes we make to our Privacy Policy in the future will be published through this page and, if necessary and/or any material changes we will notify you via email. Please revisit this page from time to time to see any updates or changes to our Privacy Policy .

When permitted by the provisions of the legislation, the continued use of our services and Applications or expressing consent will be considered to be your consent and acceptance of changes we make to our Privacy Policy.
